Rider Agreement

This agreement outlines the terms and conditions governing the relationship between DeliveryWe Ltd and riders operating as independent contractors in the UK.

Rider Agreement

1. Independent Contractor Status

  • 1.1 The Rider is engaged as an independent contractor and not as an employee, partner, or agent of the Company.
  • 1.2 Nothing in this agreement creates an employment relationship, and the Rider is responsible for their own taxes, National Insurance, and insurance obligations.

2. Rider Obligations

2.1 The Rider shall:

  • Perform deliveries in a professional, safe, and timely manner.
  • Comply with all applicable UK laws, including road traffic and health & safety regulations.
  • Provide and maintain their own equipment (e.g., bike, scooter, mobile device).
  • Keep accurate records of deliveries as required by the Company.

2.2 The Rider must not engage in any activity that conflicts with the Company's interests or damages its reputation.

3. Company Obligations

3.1 The Company shall:

  • Provide clear information about delivery assignments.
  • Remit agreed payment promptly according to the payment schedule.
  • Provide reasonable support regarding operational procedures and safety guidance.

4. Payment Terms

  • 4.1 Payment will be made [weekly/monthly] based on completed deliveries, at the agreed rates.
  • 4.2 The Rider is responsible for all tax and National Insurance contributions arising from this agreement.
  • 4.3 The Company reserves the right to deduct amounts owed to the Company for losses or damages caused by the Rider's negligence.

5. Health, Safety & Insurance

  • 5.1 The Rider shall comply with Health and Safety at Work Act 1974 and take all reasonable precautions to ensure personal safety.
  • 5.2 The Rider must maintain valid vehicle insurance covering delivery work.
  • 5.3 Any accidents or injuries must be reported to the Company immediately.

6. Confidentiality & Data Protection

  • 6.1 The Rider must maintain the confidentiality of customer information and operational data.
  • 6.2 Compliance with UK GDPR is mandatory; the Rider shall not share customer data with any third party.

7. Intellectual Property

  • 7.1 Any materials, content, or data created by the Rider in connection with the Company's operations shall be the sole property of the Company unless otherwise agreed in writing.

8. Termination

  • 8.1 Either party may terminate this agreement with [insert notice period, e.g., 7 days] written notice.
  • 8.2 Immediate termination is permitted in cases of:
  • Gross misconduct or illegal activity.
  • Breach of the Company's policies or this agreement.

9. Liability & Indemnity

  • 9.1 The Rider is responsible for any loss, damage, or claims arising from their own negligence or misconduct.
  • 9.2 The Rider shall indemnify the Company against any costs, claims, or damages caused by failure to comply with this agreement.

10. Dispute Resolution

  • 10.1 This agreement is governed by English law.
  • 10.2 Any disputes shall first be attempted to be resolved through mediation. If unresolved, disputes may be referred to the courts of England and Wales.

11. Compliance

  • 11.1 The Rider must comply with all applicable laws, regulations, and licensing requirements.
  • 11.2 This agreement does not override mandatory UK employment or worker rights where applicable.

Acknowledgment

By commencing work with DeliveryWe, the Rider acknowledges that they have read, understood, and agreed to the terms of this agreement.
